Terms and Conditions for Services Provided by Notberg Sp. z o.o. with its registered office in Warsaw
§1 INTRODUCTORY PROVISIONS
Notberg Sp. z o.o., hereinafter referred to as "Notberg," provides visa intermediary services, apostille and document legalization services, translation services, hotel reservations, flight tickets, local tours, and other services commissioned by the Client, hereinafter referred to as the "Services." These services are provided in accordance with these Terms and Conditions and individual agreements with Clients.
§2 DEFINITIONS
Services – the services provided by Notberg, described in §1.
Client – a natural person, legal entity, or organizational unit using Notberg's services.
Documents – all documents provided by the Client for the purpose of fulfilling the order.
Order – an order for the provision of services by Notberg placed by the Client.
§3 CONCLUSION OF THE AGREEMENT
The service agreement is concluded when the following conditions are met:
a) The Client places an order, which can be placed online, by phone, or via email.
b) Notberg confirms receipt of the order and accepts it for execution.
c) The Client makes payment according to §6, unless other payment terms are specified in separate agreements.
For agreements requiring payment before execution, work will begin once the full amount is credited to Notberg's account.
The Client is obliged to provide correct contact details. If incorrect details are provided, Notberg is not responsible for the lack of contact.
The office hours and service completion time are specified on the website under the contact information section.
§4 COURIER SHIPMENTS
The Client has the option to use their own courier, which is recommended. Notberg is not responsible for the actions of courier companies.
Courier shipments handled by Notberg are insured according to the courier companies' terms and conditions. The coverage includes the replacement value of the documents.
If the courier company offers the option to purchase additional insurance for the shipment, the Client should purchase such insurance by using their own courier.
§5 TERMS OF SERVICE
Placing an order, filling out a form, or registering on the Notberg website means granting consent for contact to confirm the order, registration, or provide information regarding the order's execution, including updates on changes to the terms and conditions, visa procedures, and other issues related to the services provided by Notberg.
The Client has the right to withdraw consent for contact at any time, but this does not affect the lawfulness of communications made before the withdrawal of consent. Withdrawing consent for contact may limit the possibility of providing certain services that require communication with the client.
§6 PAYMENT TERMS
The Client is required to make payment before the execution of the order, unless a separate agreement provides otherwise.
For agreements with Clients, the payment term is 14 days unless otherwise specified in the agreement.
In the event of non-payment, Notberg will not proceed with the execution of the order.
§7 WITHDRAWAL FROM THE AGREEMENT
The Client has the right to withdraw from the agreement and receive a full refund if the cancellation occurs before the payment of consular fees or other charges related to the execution of the order.
If withdrawal occurs after the payment has been made, the refund will be proportional to the work completed and costs incurred.
§8 COMPLAINTS
Complaints about the provided services must be submitted in writing within 14 business days of receiving the documents, and in the case of visa intermediary services, after the completion of the procedure. Failure to submit a complaint within this period means the loss of the right to make a complaint, unless due to reasons beyond the Client's control they were unable to submit the complaint in time.
The Client has the right to pursue claims in accordance with applicable law, but the time to pursue claims cannot be shorter than 12 months from the day the service was provided.
§9 NOTBERG'S LIABILITY
Notberg is responsible for performing the services in accordance with the agreement, with due diligence. Notberg’s liability is limited to the amount of the fee paid by the Client for a specific order.
Notberg is not liable for situations arising from force majeure, including war, strikes, natural disasters, government decisions, delays in the actions of administrative bodies (e.g., embassies, authorities), or other circumstances beyond the company’s control.
§10 FORCE MAJEURE
Force majeure means events that are beyond the control of the parties, including wars, strikes, fires, natural disasters, changes in legal regulations, government decisions, and other events that the parties could not foresee or avoid.
In the event of force majeure, Notberg is not liable for failing to meet the terms of the agreement. The service execution time may be extended, and the Client will be promptly informed of the situation.
§11 PERSONAL DATA PROTECTION
The Client grants consent for the processing of their personal data to the extent necessary for the execution of the ordered services.
The data controller is Notberg Sp. z o.o. with its registered office in Warsaw, ul. Wspólna 50A/22.
The Client's personal data is processed in accordance with GDPR and used exclusively for the purpose of fulfilling the contract.
The Client has the right to access their personal data, correct it, delete it, restrict its processing, transfer data, and file a complaint with the supervisory authority.
Personal data is stored for the period necessary to provide services and in accordance with applicable laws.
§12 INTELLECTUAL PROPERTY RIGHTS
All content and materials available on Notberg's website are protected by copyright and may not be copied, distributed, or used for commercial purposes without Notberg's consent.
§13 CHANGES TO THE TERMS AND CONDITIONS
Notberg reserves the right to make changes to these terms and conditions. The Client will be informed of any changes electronically or through a notice on the website.
Changes to the terms and conditions come into effect on the day of their publication on the Notberg website.
§14 LEGAL RELATIONS AND DISPUTE RESOLUTION
All disputes related to services provided by Notberg shall be resolved by a common court with jurisdiction over the registered office of Notberg, subject to the provisions concerning consumers, according to which disputes are resolved according to the place of residence of the consumer.
